Terms and conditions

  1. Shipment Dates
    Smart Logistics GP agrees to have the vehicle(s) described in this shipping form transported on or about the dates requested. Smart Logistics GP will find a licensed carrier (“Carrier” or “Agent”) to fulfill the terms of this agreement. However, Smart Logistics GP does not guarantee a specific pickup or delivery date. The normal pickup timeframe is typically within one to three (1–3) business days from the first available pickup date.

  2. Carrier’s Bill of Lading
    This order is subject to all terms and conditions of the Carrier’s bill of lading, copies of which are available at the Carrier’s office and are incorporated herein.

  3. Carrier Responsibility
    The Carrier’s responsibility begins when the shipper (or their agent) signs the bill of lading at pickup and ends when the shipper (or their agent) signs the bill of lading at delivery. If the shipper becomes unavailable for pickup or delivery, Smart Logistics GP must be notified, and a designated agent must be arranged. If a Carrier arrives and cannot pick up the vehicle, an additional USD 75.00 rescheduling fee may apply.

  4. Loading and Unloading
    Smart Logistics GP hereby informs the shipper that their vehicle will be driven onto and off of the transporter or to/from the transporter at pickup or delivery. If the Carrier cannot access the exact pickup or delivery address, it is the consignee’s responsibility to meet the transporter at a suitable location. Failing to do so does not relieve the consignee of the obligation to pick up or receive the vehicle.

  5. Payments and Deposits

    • Smart Logistics GP does not require payment until the day your vehicle is assigned to a Carrier.
    • At the time of order placement, you provide a credit card to keep on file. This card is authorized at the time the order is placed.
    • When your vehicle is dispatched to a Carrier, Smart Logistics GP will process the deposit payment.
    • The remaining balance is due at delivery (in cash or via cashier’s check) directly to the Carrier.
    • Please ask about any special policies for off-shore, overseas, or international shipments.
  6. No Guarantee of Specific Carrier
    Smart Logistics GP does not guarantee that transport will be handled by any particular driver or Carrier.

  7. Inoperable Vehicles

    • Inoperable vehicles may require the shipper’s assistance in loading or unloading at the driver’s discretion.
    • If a vehicle becomes inoperable during transport, an additional USD 150.00 will be due at delivery, on top of any other amounts owed.
    • It is the shipper’s responsibility to ensure the vehicle is in working order (e.g., functional battery, alternator, cables). Any mechanical issue that renders the vehicle inoperable during transport will incur the USD 150.00 fee.
  8. Personal or Household Items
    Smart Logistics GP and its agents do not knowingly transport vehicles containing personal or household items, as prohibited by federal regulations. Any items shipped unbeknownst to Smart Logistics GP or its agents become the sole responsibility of the shipper. Any damages or additional fees related to these items are the shipper’s responsibility.

  9. Liability for Acts of God, Road Debris, or Vandalism
    Smart Logistics GP or its agents will not be held responsible for damages caused by vandalism, Acts of God (fire, floods, hail, sandstorms, tornadoes, earthquakes), or objects flying from the road or sky during transport. Shippers should maintain their own insurance policies for these instances. Enclosed transport is available at a higher cost for added protection.

  10. Vehicle Preparation
    It is the shipper’s responsibility to prepare the vehicle for transport by removing or securing loose parts, fragile accessories, low-hanging spoilers, fog lights, antennas, etc. Any parts that fall off in transit, and any resulting damage, are the shipper’s responsibility.

  11. Damage Claims

  • All transport fees owed must be paid in full before any damage claim can be initiated. Alternatively, you may reach a cash settlement with the Carrier if they agree.
  • Any damage must be noted on the bill of lading at delivery and signed by both the driver and the shipper. Failing to do so acknowledges that the vehicle was received in good condition, releasing Smart Logistics GP and its agents from further liability.
  • The shipper or their agent must inspect the vehicle thoroughly upon delivery.
  1. Filing a Damage Claim
  • Smart Logistics GP and its agents must be notified by phone of any damage within 24 hours of delivery.
  • The shipper must provide a written description of the damage, clear photos, and two (2) repair estimates within ten (10) days of receiving the vehicle, submitted directly to the Carrier responsible.
  • Smart Logistics GP will support you in resolving damage claims but is not responsible for Carrier negligence.
  1. Jurisdiction and Liability
  • The shipper specifically waives the right to bring any legal action in a location other than where Smart Logistics GP is headquartered.
  • Smart Logistics GP is only liable for up to the deposit amount indicated in your quotation.
  • Smart Logistics GP will provide the Carrier’s insurance certificate and details upon request if any dispute arises but cannot be held responsible for Carrier-related damages or delays.
  1. Cancellation Policy
  • You may cancel an order anytime before your vehicle is assigned to a Carrier for a full refund of all monies paid to Smart Logistics GP.
  • If the vehicle is dispatched (assigned) to a Carrier before a cancellation notice is received, the deposit may be forfeited.
  • A USD 75.00 fee may be charged to cover the Carrier’s costs if they have already been assigned (gas, logistics, lost fees).
  • If a Carrier fails to load your vehicle within five (5) business days from your first available pickup date, you may cancel and receive a full refund, or request Smart Logistics GP to assign a different Carrier.
  1. Broker Role
    Smart Logistics GP is a licensed and bonded Property Broker, responsible for booking shipments with licensed Motor Carrier corporations. Each Carrier manages its own damage claims process, which may take time as drivers must return original Bill of Lading condition reports to their terminal.

  2. Port Facilities
    Smart Logistics GP is not responsible for any storage or demurrage fees at port facilities.

  3. Acceptance of Terms
    By submitting an order online or providing a deposit via credit card, PayPal, or check, you (the customer) agree to these Terms & Conditions in lieu of a signature. The most current version of these Terms & Conditions is also available on Smart Logistics GP’s website.

  4. Vehicle Availability
    Customers must ensure the vehicle remains available throughout the transport window. If the vehicle becomes unavailable after an order has been placed and a Carrier has been assigned, Smart Logistics GP may cancel the order in accordance with the cancellation policy.

  5. Delays and Additional Costs
    Smart Logistics GP is not responsible for storage fees, rental car charges, or other incidental costs incurred because of Carrier delays.

  6. Carrier Responsibility for Claims
    The Carrier assigned is solely responsible for any claims. By releasing the vehicle to the Carrier, the customer accepts the Carrier’s terms. Copies of the Carrier’s damage claim procedures can be requested at pickup or delivery, or directly from the Carrier by phone or email. Neither Smart Logistics GP nor its agents are responsible for:

  • Undercarriage, exhaust system, suspension, wheel bearings, tie-downs, brakes, alignment, tuning, charging systems, or battery.
  • Damage not visible during pickup due to poor weather or lighting.
  • Car phones or antennas.
  • Audio or video equipment not factory-installed.
  • Damage from unsecured personal items.
  • Road or sky debris.
  • Cloth or vinyl convertible tops over two (2) years old.
  • T-tops, boots, bras, caps, or canvas coverings.
  • Leaking fluids such as battery acid, oil, brake fluid, or coolant.
  • Damage caused by freezing of cooling systems or batteries.
  • Failure of factory tie-downs, or pull-through from tie-down holes.
  • Damage to any vehicle that cannot be driven onto or off the transport under its own power.
  1. Carrier Authorization
    By the shipper’s (or agent’s) signature, the Carrier and its employees are authorized to operate and transport the vehicle between the points of origin and destination specified in the bill of lading.

  2. Ownership or Authorization
    The customer confirms they are either the legal owner or have been authorized by the legal owner to enter into this agreement. By placing the order, the customer affirms they have the authority to schedule transport on behalf of the vehicle’s owner.
